I am required to provide a valid credit card (Visa, MasterCard or American Express) and a printout of the email reservation confirmation when redeeming the FanVision at an on-site FanVision? kiosk. By taking possession of all FanVision? equipment, I agree and accept to the following: (a) I declare being at least 18 years of age; (b) I accept full responsibility in case of loss, theft or damage until the equipment is returned in an undamaged good working condition; (c) to cover the risk of damages or losses, I acknowledge that FanVision is authorised to collect ?250.00 ?200 on my credit card, for any FanVision unit or ?50 for any headset that is not returned, or is lost or broken . If I do not return the product immediately following the race, I understand that my credit card will be debited and charged a non-refundable ?25.00 ?50 late fee. If I do not return the device in the 2 subsequent weeks following my contract's due date, my credit card will be debited and charged a ?225.00 non refundable and a ?200 lost product fee which will be refunded if the unit is subsequently returned to the address shown in our F1 FAQs.
The FanVision? wireless handheld spectator device and equipment ("FanVision? ") is meant to give its user a better on-site viewing experience of sporting events. FanVision (as defined hereinafter *) has taken all reasonable measures to ensure quality, reliability and accuracy of the FanVision? experience and shall make its best effort to deliver good quality broadcast and relevant information. FanVision warrants that the FanVision? will perform in accordance with its publicized specifications. HOWEVER, FANVISION AND ITS SUPPLIERS DO NOT AND CANNOT WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN BY USING THE FANVISION?. ANY CONTENT OR INFORMATION ACCESSED BY OR THROUGH THE FanVision? DEVICE IS PROVIDED "AS IS", "WITH ALL FAULTS" AND "AS AVAILABLE". In cases where the FanVision? does not perform reasonably under normal conditions, FanVision may, at its sole discretion, choose to replace a defective unit or reimburse the portion of the rental for which there was no service, provided the device was rented.
UNDER NO CIRCUMSTANCES WILL FanVision OR ITS SUPPLIERS BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, DIRECT OR INDIRECT, INCIDENTAL OR SPECIAL DAMAGES ARISING FROM THE USE OF FANVISION? DEVICE, INCLUDING ANY INJURIES, LOSS OF PROFITS OR LOST SAVINGS, EVEN IF A FANVISION REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. IN NO EVENT WILL FANVISION'S LIABILITY UNDER THIS AGREEMENT EXCEED THE VALUE OF THE CONSIDERATION IT HAS RECEIVED HEREUNDER. Some countries, states or jurisdictions do not allow the exclusion or limitation of incidental, consequential or special damages, so the above limitations may not apply to you.
THE FOREGOING STATES THE SOLE AND EXCLUSIVE REMEDIES FOR FANVISION OR ITS SUPPLIERS' BREACH OF WARRANTY. EXCEPT FOR THE FOREGOING LIMITED WARRANTY, FANVISION AND ITS SUPPLIERS MAKE NO WARRANTIES, EXPRESS OR IMPLIED, AS TO ACCURACY, COMPLETENESS AND CURRENTNESS OF ANY CONTENT OR INFORMATION AVAILABLE THROUGH FANVISION? DEVICE, NON-INFRINGMENT OF THIRD PARTY RIGHTS, MERCHANTABILITY, OR FITNESS FOR ANY PARTICULAR PURPOSE. FANVISION WILL NEVER TAKE RESPONSIBILITY IN A CASE OF FORCE MAJEURE OR ACT OF GOD. Some countries, states or jurisdictions do not allow the exclusion or limitations on the duration of an implied warranty, so the above limitations may not apply.
